Introduction

These Terms and Conditions govern all services provided by Interview Performance Ltd, including candidate coaching, interview preparation, application and CV coaching and sales coaching.


By purchasing, booking, or participating in any service provided by Interview Performance Ltd, you agree to be bound by these Terms and Conditions.


Interview Performance Ltd reserves the right to amend these Terms and Conditions from time to time. The latest version will always be available on our website.

Services

Interview Performance Ltd provides professional interview coaching, application and CV coaching, assessment centre preparation, leadership coaching, and sales coaching.

All service descriptions, pricing, and content displayed on the website are provided in good faith and are believed to be accurate at the time of publication. However, Interview Performance Ltd reserves the right to:

• Change or update service descriptions, specifications, and pricing;

• Modify coaching programmes and training content;

• Withdraw services without prior notice;

• Refuse service where it is reasonable to do so.

Any changes will not affect bookings that have already been confirmed and paid for.

Payment Terms

Candidate Coaching

All coaching sessions must be paid for in full prior to the commencement of the service.

Payment may be made using approved credit or debit cards through our secure payment provider, Stripe or directly into our company bank account.

All payments are subject to validation and authorisation by the relevant card issuer and payment processor. Interview Performance Ltd accepts no responsibility for delays, declined payments, or losses arising from payment authorisation failures.

A coaching booking is not deemed confirmed until full payment has been received and cleared. Any preparation work relating to the coaching assignment will commence only after payment has been received.

Candidate Responsibilities

Candidates are responsible for:

• Providing accurate and complete information relevant to their coaching requirements;

• Attending sessions at the agreed time;

• Preparing appropriately for coaching sessions where requested;

• Making independent decisions regarding career and employment opportunities.

Coaching is a collaborative process and results depend upon the commitment, participation, and actions of the client.

Limitation of Liability

Candidate Coaching

Interview Performance Ltd and its coaches provide guidance, advice, and support based on professional experience and best practice.

However, we do not guarantee:

• Job offers;

• Interview success;

• Career progression;

• Salary increases;

• Appointment to any position; or

• Any other specific outcome.


Interview Performance Ltd shall not be liable for any:

• Loss of earnings;

• Loss of opportunity;

• Loss of employment;

• Loss of business;

• Loss of profit;

• Indirect or consequential losses; or

• Decisions made by employers, recruiters, hiring managers, or assessment panels.


Clients remain solely responsible for all decisions taken before, during, and after the recruitment process.

Nothing in these Terms shall exclude liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded under English law.

Cancellation, Rescheduling and Refunds

Candidate Coaching

Client Rescheduling

Online coaching sessions conducted via Zoom or other virtual platforms cancelled or rescheduled within 24 hours of the scheduled start time will incur a charge of 50% of the session fee.

Non-Attendance

Failure to attend a scheduled coaching session without prior notice will be treated as a cancellation and charged at the applicable rate.

Satisfaction Guarantee

Interview Performance Ltd offers a Satisfaction Guarantee for candidate coaching services.

If a client believes they have not benefited from a coaching session, they must notify their coach within 30 minutes of the session ending.

Following review of the circumstances, Interview Performance Ltd may offer a full refund at its sole discretion where it determines that the Satisfaction Guarantee criteria have been met.

Refund requests made outside this timeframe will not normally be considered.

Intellectual Property

All intellectual property rights, including copyright, trademarks, training materials, coaching materials, methodologies, presentations, documents, graphics, branding, website content, and associated materials remain the exclusive property of Interview Performance Ltd.

Clients are granted a non-transferable, non-exclusive licence to use any materials provided solely for their personal or internal business use.

Without prior written permission from Interview Performance Ltd, no part of our materials may be:

• Copied;

• Reproduced;

• Adapted;

• Modified;

• Published;

• Shared;

• Distributed;

• Recorded;

• Uploaded;

• Commercially exploited; or

• Repurposed for training or consultancy services.

These restrictions apply to all formats and media, whether physical, electronic, or digital.

Confidentiality

Interview Performance Ltd treats all client information as confidential and will not disclose information obtained during coaching or training engagements to third parties except:

• Where required by law;

• Where necessary to deliver agreed services; or

• With the client's express consent.

Clients agree to respect the confidentiality of any proprietary information, methodologies, or materials provided by Interview Performance Ltd.

Data Protection and Privacy

Interview Performance Ltd is committed to protecting personal data and complying with applicable data protection legislation, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Force Majeure

Interview Performance Ltd shall not be liable for delays or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including but not limited to:

• Natural disasters;

• Severe weather;

• Industrial disputes;

• Internet or platform failures;

• Government restrictions;

• Public health emergencies;

• Transport disruption; or

• Utility outages.

Where reasonably possible, affected services will be rescheduled.

Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
